Platinum Edge Properties respects your privacy. This policy explains how we collect, hold, use and disclose personal information when providing real estate services and operating our website.

1. About this policy

This Privacy Policy applies to Platinum Edge Properties Pty Ltd (ABN 55 601 357 340), trading as Platinum Edge Properties (we, us or our), including our residential, acreage, commercial, development, appraisal, sales, leasing and property management activities, our website at platinumedgeproperties.com.au, and our communications with clients, customers and other contacts.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles (APPs) and other applicable laws, including anti-money laundering and counter-terrorism financing (AML/CTF), property, tenancy, electronic communications and record-keeping laws.

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether it is recorded in a material form or not.

2. The personal information we collect

The kinds of personal information we may collect depend on how you deal with us and may include:

  • identity and contact details, such as your name, address, email address, telephone number, date of birth and signature;
  • property details, ownership information, title and land information, property preferences, appraisal information, photographs, floorplans and inspection records;
  • transaction and financial information, such as offer terms, purchase price, deposit details, rental and payment information, bank account details where required, and records relating to a proposed or completed transaction;
  • identity verification and AML/CTF information, including copies or details of identity documents, verification outcomes, beneficial ownership, source-of-funds or source-of-wealth information, and risk or compliance records where required by law;
  • communications and relationship information, including enquiries, emails, telephone notes, messages, appointment records, feedback and marketing preferences;
  • information relevant to a tenancy or property management service, such as rental applications, employment or income information, references, rental history, occupancy information and emergency contacts;
  • technical and website information, such as IP address, browser and device information, pages visited, form submissions, cookies and similar technologies; and
  • other information you provide to us, or that we are authorised or required by law to collect.

Some information may be sensitive information under privacy law. We will collect sensitive information only where permitted by law, including where you consent or where collection is required or authorised by law.

3. How we collect personal information

We may collect personal information:

  • directly from you in person, by telephone, email, SMS, online form, social media, at an inspection or open home, or through contracts and other documents;
  • from sellers, buyers, landlords, tenants, applicants, occupants, guarantors, representatives and people acting on their behalf;
  • through our website and online enquiry, appraisal, offer, application and subscription forms;
  • from real estate portals and advertising platforms, including realestate.com.au (REA Group), Domain and social media platforms, when you submit an enquiry or interact with an advertisement;
  • from our customer relationship management and agency systems, including REX;
  • from property, identity and data service providers, including RP Data/CoreLogic, ID4me, title and government registers, local authorities, publicly available records and other lawful data sources;
  • from solicitors, conveyancers, accountants, valuers, building and pest inspectors, tradespeople, body corporates, insurers, financiers, utility providers and other parties involved in a property matter; and
  • from third parties where you have consented, where we reasonably believe collection is authorised, or where collection is otherwise permitted by law.

If you provide personal information about another person, you should ensure you are authorised to do so and, where appropriate, make them aware of this policy.

4. Why we collect, hold, use and disclose information

We may collect, hold, use and disclose personal information to:

  • respond to enquiries and provide appraisals, agency, sales, leasing, property management, commercial and development-related services;
  • identify and communicate with clients, customers, prospective clients, buyers, sellers, landlords, tenants and applicants;
  • create and manage property listings, match people with properties, arrange inspections, receive and communicate offers, negotiate transactions and administer contracts;
  • advertise and promote properties through websites, portals, databases, email, SMS, print and social media;
  • assess applications, verify information, obtain references and administer tenancies or managed properties;
  • undertake identity verification, customer due diligence, sanctions or risk screening, monitoring, reporting and record keeping required by AML/CTF and other laws;
  • maintain our CRM, business records and contact database, improve our services and train or supervise staff;
  • send property alerts, market updates, invitations and other direct marketing where permitted;
  • prevent fraud, misuse, security incidents and unlawful activity;
  • manage complaints, disputes, legal claims, insurance and regulatory matters; and
  • comply with laws, court orders and lawful requests from regulators, law enforcement and government agencies.

If we cannot collect information reasonably required for these purposes, we may be unable to verify your identity, respond to an enquiry, provide a service, progress a transaction or comply with our legal obligations.

5. Identity verification and AML/CTF checks

We may use third-party identity, verification and data services, including ID4me and other providers, to verify identity and contact details, validate documents, confirm ownership or beneficial ownership, conduct compliance checks and meet AML/CTF obligations.

These checks may involve comparing information you provide against government, public, commercial or other reference data. Information may also be disclosed to our verification or compliance providers, professional advisers, AUSTRAC and other authorities where required or authorised by law.

We will seek to collect only the identity and compliance information reasonably necessary for the relevant purpose. We retain such records for the period required by applicable law and then securely destroy or de-identify them where lawful and practicable.

6. Who we may disclose personal information to

We may disclose personal information, where reasonably necessary for our functions or permitted by law, to:

  • the parties to a property transaction or tenancy and their authorised representatives;
  • our employees, contractors, related businesses and service providers;
  • REX and other CRM, agency, document management, electronic signing, communications, website, hosting, cloud storage and cybersecurity providers;
  • REA Group, Domain, social media platforms and other property advertising, marketing and enquiry platforms;
  • CoreLogic/RP Data, ID4me and other property data, identity verification, AML/CTF, fraud prevention and data quality providers;
  • solicitors, conveyancers, accountants, valuers, photographers, floorplan providers, tradespeople, inspectors, body corporates, insurers, financiers and utility or connection providers;
  • referees, employers and tenancy database or screening providers where relevant and lawful;
  • government agencies, courts, tribunals, regulators, law enforcement bodies and AUSTRAC where required or authorised; and
  • a prospective purchaser, adviser or successor if our business or assets are restructured, sold or transferred, subject to appropriate confidentiality arrangements.

We do not sell personal information as a standalone product. Property and contact information may, however, be used or disclosed as part of providing real estate, marketing, data, compliance and transaction services described in this policy.

7. Direct marketing

Where permitted by law, we may use your contact details to send you property alerts, appraisal or market updates, newsletters, invitations and information about services that may interest you. We may contact you by email, SMS, telephone, post or through online advertising.

You can opt out at any time by using an unsubscribe facility in the message, replying STOP where available, or contacting us using the details below. We will process opt-out requests within a reasonable period. Opting out of marketing will not stop communications needed to provide a service or administer a current matter.

8. Our website, cookies and third-party links

Our website may use cookies, pixels, analytics and similar technologies to operate the site, remember preferences, understand usage, measure advertising and improve our services. You can adjust browser settings to reject or limit cookies, although parts of the website may not function as intended.

Our website may contain links to third-party websites or services. Their privacy practices are governed by their own policies, and we are not responsible for their handling of personal information.

9. Storage, security and retention

We may hold personal information in electronic systems and, where necessary, in paper records. These may include REX, email and communications systems, cloud services, transaction files and secure third-party platforms.

We take reasonable steps appropriate to our operations to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. Measures may include access controls, passwords, multi-factor authentication where available, staff procedures, secure service providers, backups and secure disposal practices. No method of storage or transmission is completely secure.

We retain personal information for as long as reasonably needed for the purposes described in this policy and to meet legal, accounting, insurance, dispute and regulatory requirements. When information is no longer required, we take reasonable steps to destroy it securely or de-identify it, unless we are required or authorised to retain it.

If an eligible data breach occurs, we will take steps required under the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

10. Overseas disclosure

Some technology, cloud, communications, analytics, advertising, verification or support providers may store or process information outside Australia. Depending on the provider and service used, those locations may include the United States and other countries in which the provider or its subcontractors operate.

Where personal information is disclosed overseas, we take reasonable steps required by law in relation to that disclosure. Overseas recipients may be subject to privacy laws different from Australian law. Contact us if you would like more information about likely overseas disclosures relevant to your dealings with us.

11. Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Please contact us in writing and provide enough detail for us to identify the relevant information. We may need to verify your identity before responding.

We will respond within a reasonable period. In some circumstances permitted by law, we may refuse access or correction, or charge a reasonable fee for providing access. If so, we will generally give written reasons and explain available complaint options.

13. Anonymity and pseudonyms

Where lawful and practicable, you may interact with us anonymously or using a pseudonym. This will generally not be practicable where we need to identify you to provide agency services, enter into or administer a transaction or tenancy, verify identity, or comply with legal and regulatory obligations.

14. Changes to this policy

We may update this policy when our practices, systems or legal obligations change. The current version will be published on our website and will state its effective date. We encourage you to review it periodically.
